    Account Type Code 95: Attorney-Fee Loan

    Account Type Code 95 means "Attorney-Fee Loan". An installment loan taken out by a consumer to pay legal fees, repaid on a fixed schedule to the lender that financed them. It is reported in Account Type (Field 15) of the Base Segment, 2 characters at position 84.

    What Account Type Code 95 means

    • An ordinary fixed-term installment loan whose proceeds paid a legal bill. The purpose is what selects the code.
    • The lender may be a specialty finance company or a bank; the attorney is the payee of the proceeds, not the furnisher.
    • Does NOT mean an attorney collecting a debt. A collection attorney furnishing a placed account reports Account Type 48.
    • Does NOT mean an unpaid legal bill owed directly to a law firm. That is not a financed loan, and financing is what makes this an installment obligation.
    • Does NOT mean litigation funding advanced against a case outcome. A non-recourse advance repayable only from proceeds is not a scheduled installment loan.

    When to report 95

    • 1A specialty lender reports a 24-month loan that funded a consumer's legal fees, repaid monthly.
    • 2A bank reports an attorney-fee loan being repaid on schedule with the balance falling each cycle.
    • 3A lender reports an attorney-fee loan that went delinquent after the borrower missed several installments.
    • 4A lender reports an attorney-fee loan paid in full at maturity and closes the tradeline at zero.
    • 5A lender reports an attorney-fee loan on which the borrower negotiated a modified payment schedule.

    Reporting rules

    • Report the amount financed as the Original Loan Amount and the remaining principal as the Current Balance.
    • Do not describe the legal matter anywhere in the record. The Account Type is the whole of what the file needs to say.
    • Do not code a law firm's own unpaid invoice as 95. Without a financing agreement, there is no installment loan.
    • Report a modified schedule prospectively in Terms Duration and Scheduled Monthly Payment.
    • Report the loan every cycle rather than only when it is delinquent.

    Codes and fields that must agree

    A file can be structurally valid and still be wrong. These are the cross-field conditions Account Type Code 95 has to satisfy.

    • Portfolio Type must be I (Installment).
    • Portfolio Type I requires Terms Duration in months and a populated Scheduled Monthly Payment while the loan is open, and does not use Credit Limit.
    • Terms Frequency is normally M (Monthly) and must agree with the Scheduled Monthly Payment.
    • Original Loan Amount must be greater than zero and must not move; only Current Balance changes as the loan amortizes.
    • Date Opened is the funding date of the loan, not the date the legal services began.
    • If the loan is later charged off and placed for collection, the collecting party's Account Type 48 tradeline carries a K1 Original Creditor Name identifying you, and your tradeline must not continue reporting the same open balance.
    • Original Charge-Off Amount must be populated when the account charges off, and it must be the amount charged off rather than a balance that keeps growing with post-charge-off interest.
    • Date of First Delinquency is the first missed installment that was never cured, and it does not reset when the loan is modified or placed.
    • Amount Past Due must reconcile with the Payment History Profile and Account Status; delinquent months with a zero Amount Past Due is a contradiction.
    • A co-borrower ships in a J1 or J2 segment with a joint or co-maker ECOA code, never as a second Base Segment for the same loan.
